Our story

Starlight Legal is a fast growing Australian-Chinese law firm with its strongest focus on family law, migration law, and commercial law matters. For the last 10 years, our Principal Lawyer Eva has advised and acted for a multitude of complex and sensitive matters across different areas of laws and cultures.

“From a Chinese background, my strength is to advocate for migrants who have found themselves trapped in family law issues.” Eva specialises in divorce property settlement matters involving trust properties, business interests, corporate shares and dealing with assets in China. She has also worked on children related issues including sole parenting, international relocation, extended families’ rights (grandparents’ rights). Having the experience of working for predominant Chinese-Australian individuals, Eva developed the skills of making sure that her client’s cultural values are validly considered by the court when the law does not necessarily operate in their favour.

Questions And Answers

Divorce in Australia is governed by federal law and falls under the jurisdiction of the Family and Federal Circuit Court of Australia. The legal aspects can be complex, especially if there are children, property, or financial matters involved. A lawyer can help you understand your rights, obligations, and options and can guide you through the entire process to make sure everything is done correctly.
Keep in mind that laws and regulations may change, so it’s important to consult with a legal professional who has up-to-date knowledge of the current laws and procedures in Australia.

The cost of separation in Australia can vary widely depending on several factors, including the complexity of your situation, whether you have children, whether there are property and financial matters to be addressed, and whether you and your partner can reach an agreement amicably or if the process becomes contested. Here are some potential costs to consider:

  1. Legal Fees: Hiring a lawyer to assist with your separation can be a significant expense. Lawyers typically charge by the hour, and their fees can vary based on their experience, location, and the complexity of your case.
  2. Court Fees: If your separation involves court proceedings, there will be court filing fees. These fees can vary depending on the type of case and the court involved.
  3. Mediation and Dispute Resolution Costs: If you and your partner are trying to work out issues such as property division, child custody, and support through mediation or dispute resolution, there may be costs associated with these services.
  4. Property Valuation Costs: If you have property that needs to be divided, you may need to get professional property valuations, which can incur costs.

If you are facing domestic violence-related charges or an Application for an Apprehended Violence Order (AVO) in Australia, it’s important to take the situation seriously and seek legal advice immediately. Dealing with domestic violence allegations can be complex and have serious legal consequences. Here are some steps you should consider taking:

  1. Consult a Lawyer: It’s crucial to seek legal advice from a qualified criminal defence lawyer who specializes in domestic violence cases. They can guide you through the legal process, explain your rights, and help you build a strong defence strategy.
  2. Understand the Charges and AVO: Make sure you fully understand the charges against you and the details of the AVO application. Your lawyer can explain the allegations, the evidence, and the potential consequences.
  3. Comply with Legal Orders: If an interim AVO or any other legal orders have been issued against you, it’s important to comply with them. Failure to comply with court orders can lead to further legal trouble.
  4. Attend Court Hearings: If you are required to attend court hearings, make sure you do so. Failing to appear in court can lead to a warrant being issued for your arrest.
  5. Follow Legal Advice: Listen to and follow the advice of your lawyer. They are experienced in navigating the legal system and can provide guidance on how to present your case effectively.

The cost of hiring a criminal lawyer can vary widely depending on a range of factors, including the complexity of the case, the lawyer’s experience and reputation, the geographic location of the lawyer’s practice, the type of legal services needed, and the amount of time and effort required to handle the case. Here are some common fee structures that criminal lawyers may use:

  • Hourly Rate: Many criminal lawyers charge by the hour. The hourly rate can vary significantly depending on the lawyer’s experience and the region. Hourly rates for experienced criminal lawyers might range from a few hundred dollars to over a thousand dollars per hour.
  • Fixed Fee: Some criminal lawyers offer fixed fee arrangements for specific legal services, such as representing you at a court hearing or handling a particular aspect of your case. This provides you with a clear understanding of the cost upfront.

Hiring a lawyer for preparing a visa application can provide several benefits, although it’s not a requirement in all cases. Here are some reasons why you might consider seeking legal assistance when applying for a visa:

  1. Complexity of Immigration Laws: Immigration laws and regulations can be complex and subject to frequent changes. A lawyer who specializes in immigration law will have a thorough understanding of the current laws, policies, and procedures, ensuring that your application is prepared correctly and in compliance with all requirements.
  2. Individualized Advice: A lawyer can assess your unique circumstances, including your eligibility, potential issues, and available pathways. They can provide personalized advice on which visa option is most suitable for your situation and help you avoid common pitfalls.
  3. Application Strategy: Lawyers can develop a comprehensive application strategy tailored to your specific case. They can help you present your case in the best possible light, highlighting your strengths and addressing any weaknesses.
  4. Document Preparation: Visa applications typically require extensive documentation. A lawyer can guide you in gathering and preparing the necessary documents, ensuring that they are accurate, complete, and properly formatted.
  5. Form Completion: Immigration forms can be complex and have specific requirements. A lawyer can assist in accurately completing the required forms, minimizing the risk of errors that could lead to delays or rejections.
  6. Legal Compliance: Ensuring legal compliance is crucial to avoid visa application rejections or future immigration issues. Lawyers can help you navigate the legal requirements, making sure your application meets all the criteria set by the immigration authorities.
  7. Communication with Authorities: If there are any questions or concerns from the immigration authorities, a lawyer can handle communication on your behalf, ensuring that your responses are accurate and appropriately framed.
  8. Appeals and Review Processes: If your application is denied or faces challenges, lawyers can guide you through the appeals and review processes, advocating for your case and increasing the chances of a successful outcome.
  9. Time and Stress Savings: Preparing a visa application can be time-consuming and stressful, especially if you’re unfamiliar with the process. Hiring a lawyer can save you time and help alleviate some of the stress by allowing you to focus on other aspects of your life.

It’s important to note that while hiring a lawyer can be beneficial, it’s not a guarantee of visa approval. Choosing a reputable and experienced immigration lawyer is key. You can research lawyers’ qualifications, read reviews, and have initial consultations to discuss your case and their approach before making a decision.
